§ 1 Scope of Application
These General Terms and Conditions (GTC) apply to all coaching, hypnosis, and consulting services provided by:

to both consumers and business clients within the meaning of §§ 13, 14 of the German Civil Code (BGB).
Any deviating terms and conditions of clients shall only apply if expressly agreed upon in writing.
§ 2 Subject Matter of the Contract
(1) The subject of the contract is coaching, hypnosis, and personal development services.
(2) The services are provided exclusively in a non-therapeutic context. They do not constitute psychotherapy, medical treatment, or the making of a medical diagnosis.
(3) Coaching and hypnosis are process-oriented methods, the effectiveness of which depends significantly on the active participation of the client.
(4) No specific outcome is guaranteed.
§ 3 Conclusion of Contract
The contract is concluded through appointment booking, written confirmation, invoicing, or the actual provision of a session. By booking, clients acknowledge and accept these General Terms and Conditions (GTC).
§ 4 Scope of Services
The specific scope of services is determined by individual agreement, offer, or program description.
§ 5 Client Responsibilities
(1) Clients bear full responsibility for their physical and psychological health.
(2) Any existing medical conditions or psychological concerns must be independently clarified with a physician or psychotherapist.
§ 6 Appointments, Cancellations & Online Sessions
(1) Agreed appointments are binding.
(2) Cancellations or rescheduling are free of charge up to 48 hours before the appointment. After this period, the full fee will be charged.
(3) In the event of cancellation by the provider, an alternative appointment will be offered.
(4) Online sessions are conducted via common video platforms (e.g., Zoom, Google Meet). The client is responsible for ensuring a stable technical connection.
§ 7 Remuneration
(1) The agreed fees are binding.
(2) Payments are made by bank transfer.
(3) Invoices are due within 14 days without deduction.
§ 8 Confidentiality
All content of the sessions is treated as confidential and will only be disclosed with explicit consent or due to a legal obligation.
§ 9 Liability
(1) Liability for slight negligence is excluded, provided that no essential contractual obligations are affected.
(2) In the event of a breach of essential contractual obligations, liability is limited to foreseeable damages.
(3) Liability for injury to life, body, or health remains unaffected.
(4) No liability is assumed for subjective effects, decisions, or consequences arising from the hypnosis or coaching process.
§ 10 Hypnosis – Special Notes
(1) Hypnosis is a state of focused attention and not unconsciousness.
(2) Participation is voluntary; clients remain in control at all times.
(3) Sessions can be terminated at any time.
(4) No specific outcome is guaranteed.
§ 11 Data Protection
The processing of personal data is carried out in accordance with the separate Privacy Policy.
§ 12 Intellectual Property Rights
(1) All materials, concepts, content, and methods are protected by copyright.
(2) Any transfer, reproduction, or publication without written consent is not permitted.
§ 13 Right of Withdrawal
Consumers are entitled to a statutory right of withdrawal of 14 days.
For services that are fully performed before the expiry of the withdrawal period, the right of withdrawal expires, provided that the client has expressly consented to the commencement of the service and the execution has begun.
§ 14 Governing Law & Jurisdiction
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) For business clients, the place of jurisdiction shall be the registered office of the provider.
(3) Mandatory consumer protection rights remain unaffected.
§ 15 Final Provisions
If individual provisions are found to be invalid, the validity of the remaining provisions shall remain unaffected.
